Senior Negri cop slashed outside his home

Tampin - May 08 - A chief inspector was slashed by an assailant outside his house in Taman Bukit Tampin near here, after returning home from playing badminton on Thursday night.

Mohd Zain Kasron, 50, who is attached with the logistics department at the district police station, was driving home from the Dewan Kampung Baru when the incident happened around 7:15pm.

He suffered injuries on his face, back and hands, and was rushed to the district hospital in an ambulance and later transferred to the Tuanku Ja’afar Hospital in Seremban.

When met at the hospital Friday, Mohd Zain said he had almost reached his house when two men on a motorcycle cut into his path and asked him to stop.

“I had no idea why they stopped me. As I got out of the car, one of them took out a machete and attacked me.

“The incident happened so fast that I couldn’t even see their faces clearly,” he said, adding that both men could be in their 30s.

His attackers fled when Mohd Zain screamed in pain.

Mohd Zain’s son, Mohd Nazrullah, 24, when met at the hospital said doctors told him his father’s condition was stable.

“I rushed back from Kuantan when my family notified me of the attack.

“We have no clue why this happened,” he said.

When contacted, state police chief SACII Datuk Osman Salleh said police were investigating the motive of the attack.

“There were no eyewitnesses,” he said.

Osman, who visited Mohd Zain at the hospital, said police have classified the case under section 326 of the Penal Code for causing grievous hurt with a weapon. StarOnline 08May09

KUALA LUMPUR, 6 Jan (Hrkh) - Program 'candlelight vigil' yang dianjurkan Gerakan Mansuhkan ISA (GMI) di Dataran Merdeka, pada malam tadi berlangsung dengan aman biarpun mendapat bantahan daripada pihak polis.

Kira-kira 300 orang mengambil bahagian dalam majlis memasang lilin sebagai membantah Akta Keselamatan Dalam Negeri (ISA) yang telah menahan seramai 90 orang tahanan tanpa dibicarakan.

Seawal jam 8.10 malam orang ramai mula berkumpul di Dataran Merdeka walaupun pihak polis telah menutup jalan di kawasan tersebut sejak awal petang semalam.

Orang ramai kelihatan berpusu-pusu memasuki perkarangan Dataran Merdeka walaupun terdapat ratusan anggota polis ditempatkan di situ. lagi

PutraJaya, Reuters, Dec 12 - Malaysia denied on Wednesday it was a police state, despite launching the biggest crackdown on anti-government activists in a decade.

Foreign Minister Syed Hamid Albar told Reuters the government was merely trying to ensure public safety in enforcing a blanket ban on street protests that has prompted opposition groups to accuse it of political repression ahead of a possible early election.

"We have never been a police state," he said in an interview in his office in the sprawling the administrative capital of Putrajaya.

"To say Malaysia is heading into a police state is an untrue statement and is an exaggeration, especially under our current PM. He is very careful, open and transparent. I think there is a limit to everything."

Prime Minister Abdullah Ahmad Badawi raised the country's expectations for reform when he took office in 2003, vowing to fight corruption and usher in more transparent, open government.

Four years later, frustrations at the slow progress of his reform agenda, coupled with discontent over rising living costs, have boiled over into the biggest street protests in nine years.

More than 20,000 people defied riot police and took to the streets of the capital, Kuala Lumpur, in two separate protests over the past five weeks, on issues that chimed with the clamour for reform: fairer politics and more equal race relations.

The last major rally, staged by more than 10,000 ethnic Indians complaining of racial discrimination, drew world attention, particularly from India, whose prime minister voiced sympathy for the plight of the Indian diaspora in Malaysia.

Syed Hamid, who now has the job of explaining Malaysia's actions to the world, said the government tolerated criticism but street protests risked public security and stability.

"You have to distinguish between riotous behaviour and open and transparent discussion," he said. "There is no problem with open and transparent discussion."

RIOTOUS BEHAVIOUR

He also showed irritation at a media report that the U.S. State Department had also expressed criticism of the crackdown.

"If you look at every developed country, they don't tolerate riotous behaviour," he said, citing the large deployments of riot police in Western capitals during international summits such as the Asia Pacific Economic Forum and the World Trade Organisation.

"During APEC or WTO meetings, they close up roads in order not to allow demonstrators. We are (doing) nothing more than that."

Washington said Kuala Lumpur should allow freedom of expression and peaceful assemblies.

"We have repeatedly raised with Malaysian authorities our belief that citizens of any country should be allowed to peacefully assemble and express their views," Nancy Beck, U.S. State Department spokeswoman said in a remark originally reported by AFP.

"We also stated in our human rights report our belief that the Malaysian government places significant restrictions on the right to assemble peacefully."

Opposition parties and non-governmental bodies issued a joint statement on Wednesday seeking an urgent meeting with Abdullah to discuss the "recent crises" and press for national unity.

"We intend to purse the agenda of national unity and reconciliation ..., press on with our demands for free and fair elections, and work towards resolving the serious national problems we face," said de facto opposition leader Anwar Ibrahim.

The risk of street protests turning into riots is a real fear among many Malaysians, particularly those who lived through the last major eruption of racial violence in Kuala Lumpur in 1969.

Hundreds died in those riots between ethnic Malays, who make up most of the population, and ethnic Chinese. The current prime minister played a leading role in the immediate aftermath of that crisis to find a political solution to the racial troubles.

But the opposition accuses Abdullah now of using public order and the memory of 1969 as an excuse to stifle peaceful dissent.

In seeking to protect public security, police moved last weekend in the early morning to halt an annual human-rights march by just 60 people in the near-deserted streets of Kuala Lumpur.

Syed Hamid accused Anwar, sacked and jailed after he fell out with the then Prime Minister Mahathir Mohamad in 1998, of instigating and organising the protests.

"When you start to instigate and you start to throw aspersion that can cause people to get emotional ... to organise demonstrations is not good. We have been very tolerant of him."

Hindraf: PAS kesal hak asasi rakyat dicabuli

KUALA LUMPUR, 25 Nov (Hrkh) - PAS melahirkan rasa kecewa dan dukacita di atas tindakan kerajaan yang menyekat dan menghalang perhimpunan Hindu Rights Action Force (Hindraf) yang diadakan sebentar tadi sehingga tercetus insiden tembakan gas pemedih mata ke arah orang ramai yang hadir menyuarakan pandangan mereka secara aman.

Setiausaha Agung PAS Dato' Kamaruddin Jaafar berkata hak asasi manusia tanpa mengira latar belakang keturuan, bangsa dan agama untuk melahirkan pendapat dan menyatakan bantahan harus dipatuhi dan dibenarkan oleh kerajaan yang mendakwa mengamalkan sistem demokrasi dalam negara ini.

"PAS berpendirian, walaupun tidak semestinya kita bersetuju dengan pendapat dan apa yang mereka suarakan namun semua pihak harus menghormati hak asasi mereka untuk menyuarakan pandangan dan berhimpun secara aman," katanya ketika menghubungi Harakahdaily

"Kesimpulan yang kita buat ialah, himpunan hari ini adalah sebagai isyarat dan tanda kegelisahan sebilangan besar kaum India dengan dasar kerajaan yang tidak memberi manfaat kepada golongan miskin dan tertindas sehingga nasib dan kebajikan meraka terabai," katanya.

Katanya kerajaan mesti mengambil pendekatan mendengar 'suara hati' mereka dan berusaha menyelesaikan tuntutan atau masalah yang dihadapi berbanding 'menyerang' mahupun mengambil sikap tertutup untuk berbincang termasuk menuduh dengan pelbagai cemuhan perkauman yang semakin mengundang perasaan tidak senang mereka terhadap kerajaan selama ini.

"Ini adalah lanjutan dan sambungan yang membuktikan kerajaan BN telah gagal menangani nasib masyarakat berbilang kaum yang semakin hari semakin terhimpit dan terbeban nasib mereka baik dari segi ekonomi, sosial dan pendidikan," katanya.

PAS katanya sentiasa berpegang kepada prinsip keadilan dan menghormati hak-hak manusia yang seiring dengan tuntutan agama Islam dan menyeru kerajaan supaya tidak mengamalkan sikap 'double standard' atau 'terpilih' dalam melaksanakan dasar kerajaan untuk rakyat di negara ini.

Ramli has been suspended indefinitely

KUALA LUMPUR, Nov 3 - Commercial Crimes Investigation Department director Comm Datuk Ramli Yusoff has been suspended indefinitely, following charges against him under the Anti-Corruption Act.

Inspector-General of Police Tan Sri Musa Hassan, who confirmed this, said the suspension was a normal procedure imposed on a policeman or policewoman caught for alleged corruption.

“It is a standard procedure that we have observed all this while.

“If any government officer or staff is caught and charged for corruption, we will suspend him immediately.

“We have our disciplinary committee to handle the matter and this is a normal practice,” he told reporters at a Hari Raya gathering at the Police Training College here last night.

Yang di-Pertuan Agong Tuanku Mizan Zainal Abidin graced the event, which was also attended by Prime Minister Datuk Seri Abdullah Ahmad Badawi.

Refuting suggestions that Ramli’s suspension has tarnished the image of the police force, he said such suspensions had been done before.

It is learnt that Ramli received his suspension letter at 3.30pm yesterday.

Ramli, 55, had claimed trial in a Sessions Court here on Thursday to two counts of failing to declare assets worth some RM1mil and a third count for being involved in business while still in service.

He is the highest ranked police officer to be charged with corruption.

Tragedi Batu Buruk: Pemuda PAS serah memorandum kepada PBB

KUALA LUMPUR, 24 Sept (Hrkh) - Insiden keganasan polis terhadap orang awam dalam meleraikan himpunan ceramah umum di Batu Buruk, Terengganu baru-baru ini telah di bawa ke pengetahuan Pertubuhan Bangsa-bangsa Bersatu (PBB) hari ini.

Dewan Pemuda PAS Pusat melalui Ketua Pemudanya, Salahuddin Ayob telah menyerahkan memorandum aduan pencabulan hak asasi manusia yang berlaku dalam tragedi itu kepada PBB dalam satu pertemuannya di pejabat PBB di Jalan Dungun, Damansara hari ini.

Dalam memorandum itu, Pemuda PAS mengutarakan isu penggunaan peluru hidup oleh polis ke atas orang awam semasa insiden berdarah ceramah umum anjuran Gabungan Pilihan Raya Adil dan bersih (Bersih) di Batu Buruk.

Memorandum itu diserah Salahuddin kepada wakil PBB di Malaysia dan disaksikan oleh delegasi Pemuda PAS. Lagi di Harakah..

KUALA TERENGGANU, Sep 21 - One imam has been sacked and another may face the same outcome if he is found to be directly involved in the Sept 8 riot in Batu Burok here.

State Islam Hadhari Development and Welfare committee chairman Datuk Rosol Wahid said severe action was meted out against the imam from Kampung Kebun Air, Manir, here as his behaviour was unbecoming.

He said the other imam from Kampung Pak Madah, Alor Limbat, Marang, caught on video shouting at Federal Reserve Unit personnel, during the riot, could face similar punishment.

Rosol said he has strong evidence that the imam was involved in the riot.

Rosol said the imam had misbehaved during the riot and, as a religious man, he should not have conducted himself in such a manner.

"We can't be lenient on such cases as their actions are unacceptable.

"They should be the one leading the way but these imams are manifesting negative traits while professing beliefs and opinions that they do not hold," he said. Meanwhile, more people on Friday surrendered to the police to help facilitate the probe into the riot after their pictures appeared in the newspaper.

Police earlier this week said that if the individuals sought in connection with the riot did not surrender by Friday, a manhunt would be launched to track them down.

Islam Is Against Rioting, Says Abdullah

PASIR MAS, Sept 16 (Bernama) - Islam rejects rioting which eventually causes damage to public property, said Prime Minister Datuk Seri Abdullah Ahmad Badawi.

He said rioting at public places was incompatible with a peaceful and harmonious country like Malaysia.

"People in this country want to live in peace and reject any form of violence by any group of dissatisfied individuals.

"We don't want to see any group go berserk, riot or create such disturbances.

"Allah also does not want people go on rampage and cause damage on this earth," he added at the handing-over of aid to single mothers and the poor in the Pasir Mas and Rantau Panjang parliamentary constituencies at Sekolah Menengah Kebangsaan Kangkong, here.

Present at the function were state Umno Liaison Committee chairman Datuk Seri Annuar Musa, Higher Education Minister Datuk Mustapa Mohamed and Deputy Finance Minister Datuk Dr Awang Adek Hussein.

Abdullah was responding on the rioting incidents in Jalan Sultan Mahmud and Batu Buruk, Terenggnu on Sept 8 involving hundreds of people believed to be supporters of opposition parties.

In the incident in Jalan Sultan Mahmud, the national flag was set ablaze and seven people, including four policemen, were injured following clashes with police after the crowd was told to disperse from the illegal assembly.

Abdullah said the people of this country should be thankful for the prevailing peace and political stability.

"In some other countries, the people continue to suffer due to the violent conflicts while we benefit from our country's peaceful situation.

"In fact, in certain countries, the Muslims cannot carry out their religious obligations with ease due to the tumultuous situations, while Muslims in Malaysia can do so in peace and comfort," he added.

Abdullah Arrives For Half-a-day Visit To Kelantan

KOTA BAHARU, Sept 16 (Bernama) - Prime Minister Datuk Seri Abdullah Ahmad Badawi arrived here for a half-a-day visit to Kelantan that will take him to Pasir Mas, Tanah Merah and Machang.

Abdullah and his wife, Datin Seri Jeanne Abdullah, were greeted by state Umno and Barisan Nasional (BN) component party leaders and senior federal government officials at Sultan Ismail Petra Airport in Pengkalan Chepa.

Soon after arrival, the prime minister headed to Pasir Mas to present alms to single mothers and the poor at Sekolah Menengah Kebangsaan Kangkong.

From there he will proceed to Tanah Merah to address a leader-with-the-people gathering and break fast at Sekolah Menengah Kebangsaan Tanah Merah 1, while Jeanne, in a separate programme, will hand out Hari Raya goodies to disabled children at a supermarket here.

After breaking fast, Abdullah and Jeanne will leave for Machang to perform tarawih prayers at Al-Ubudiah Mosque in Labok before returning to Kuala Lumpur.

This is Abdullah's third visit to Kelantan in less than two months, with the first on Aug 2 and on Aug 17.

Reward offered for identifying flag burner

KUALA TERENGGANU, Sep 13 - Prize money of RM5,000 and an Umrah package for Muslims is being offered for information leading to the arrest of the person pictured torching Malaysian flag during the riot at Batu Burok, here Saturday.

The State Umno Youth would hand over the money to the informer upon the arrest of the person and the offer of reward is even open to opposition members.

“This is a promise that we will keep. We want the culprit to be nabbed,'' State Umno Youth chief Razali Idris said Thursday.

He said Umno Youth wanted to know the identity of the culprit and the same sentiment is shared by other Barisan Nasional Youth.

"This is not a question of political difference but more a matter of patriotism,'' he said.

A man wearing a helmet was captured in film while torching the flag on Saturday riot. State police chief Senior Asst Comm Datuk Ayub Yaakob said police were still in the midst of identifying the man and was optimistic that the offender would be apprehended.

SAC Ayub said organisers of ceramah must apply for permits, adding that the police would only issued them if all prerequisites were met.

He said a series of ceramahs were organised without permits previously and police had only asked the organiser of Saturday’s gathering to apply for permission because of to the location of the gathering. mStarOnline

Opposition parties PAS and PKR today urged the police to reveal the identity of the man photographed burning the national flag during the clash in Kuala Terengganu over the weekend.

The photograph, which showed a man wearing a crash helmet, was published by almost all the major dailies.

In a joint press conference in Kuala Lumpur, both PAS and PKR stressed that the police were capable of identifying the culprit.

PKR Youth chief Shamsul Iskandar Akin said there were good reasons to suspect that those involved in the incident were agent provocateurs out to tarnish the name of opposition parties.

“We see the pictures in the newspapers and we know, they were taken by the police,” he claimed, adding that there were reports in the Chinese media stating that the police had confiscated the cameras of pressmen during the incident.

KUALA TERENGGANU, Sep 13 - The Imam of a mosque has landed himself in trouble for participating in Saturday night's riot at Batu Burok here.

The Imam, who is in his late 40s, was caught on police's video and was said to have acted violently during the melee.

His name was released by the police on Thursday.

State Islam Hadhari Development and Welfare committee chairman Datuk Rosol Wahid said the Imam could face disciplinary charges and subsequently risk being fired for his involvement in the riot.

"We will not tolerate this ... he should be the one setting a good example, this is sheer hypocrisy," he said.

Meanwhile, State police chief Senior Asst Comm Datuk Ayub Yaakob said police are in the midst of gathering statements from 22 of the rioters.

A report of its probe will be submitted to Deputy Public Prosecutor.

He said the probe on the riot would be carried out transparently without any prejudice.

"If my men were at fault then they would have to face the consequences," said SAC Ayub, who earlier briefed civil servants at Wisma Darul Iman here on what actually transpired on that day. theStarOnline

KUALA TERENGGANU, Sep 12 - Family members of two men who were inadvertently shot during a riot on Saturday night have lodged police reports over the incident.

The reports were made at 4.15pm and 6.35pm at district police headquarters here on Monday.

State Deputy CID chief Supt Khairi Ahrasa said the reports were made by the siblings of the men who were recuperating at Hospital Sultanah Nur Zahirah and Universiti Sains Malaysia hospital in Kubang Kerian, Kelantan.

He said police would start investigations into the two reports while probes into the riot were being conducted.

One of the injured men is being investigated for attempted murder under the Penal Code, he said.

The riot started when police tried to disperse an illegal gathering of more than 500 people at a gathering organised by Bersih, a coalition of 60 non-governmental organisations pushing for electoral reform.

The gathering was supported by opposition parties PAS, Parti Keadilan Rakyat and DAP.

Seven people were injured and 23 arrested, of whom 19 were later released.

PAS said it would hand a memorandum to Bukit Aman alleging police brutality and the use of live bullets during the riot.

PAS deputy president Nasharudin Mat Isa said the party lodged a complaint with the National Human Rights Commission of Malaysia (Suhakam) on Monday.

“We plan to take this all the way up to the United Nations Human Right Commission,” he said after the launch of the PAS For All campaign at its office in Jalan Raja Laut, Kuala Lumpur.

He said the party did not believe that the man photographed wearing a helmet and burning the national flag was a PAS member.

He said PAS would be holding another ceramah at 9.30pm on Sept 14 in Rusila, Terengganu.

Asked if they had a police permit for the gathering, he said: “We do not need one because it is within our own vicinity (compound).” theStarOnline

Desperation leads cop to snatch woman’s bag

IPOH, Sep 11 - The policeman, who was caught red-handed snatching a woman's handbag on Monday, was believed to have been driven to crime as he needed money to treat his ailing mother.

According to a police source, the 27-year-old constable, who joined the police force in 2003, was desperate for money as he also has a wife and four-month-old baby to feed.

During the 1pm incident, the constable had snatched the victim's handbag from her lap as she was sitting at the outdoor sitting area of her husband's café in Ipoh Garden South here.

He managed to run into an alley where his motorcycle was parked.

The café owner, who heard his wife's cries for help, chased after the constable who was trying to start up his motorcycle.

Upon hearing the commotion, several customers helped to catch the constable, whose identity was revealed when police arrived at the scene and checked his identification card.

It is believed that the constable, who was not in his uniform, was not working that day.

According to acting Ipoh OCPD Superintendent Lai Yong Heng, the constable was attached to the Manjoi police station.

The constable, he said, had been remanded for four days until Friday to facilitate investigations. mStarOnline

JAKARTA, 30 Aug - Pemerintah Malaysia melalui Perdana Menteri Abdullah Ahmad Badawi secara resmi meminta maaf atas insiden pemukulan oleh anggota polisi Diraja Malaysia terhadap Donald Luther Kolopita, wasit karate Indonesia.

"Malam tadi, sekitar pukul 20.00 WITA Presiden Susilo Bambang Yudhoyono menerima telepon dari PM Malaysia yang intinya pernyataan penyesalan dan meminta maaf sedalam-dalamnya (provound appologize) atas kejadian itu," kata Juru Bicara Kepresidenan, Dino Pati Djalal di Istana Tampak Siring, Bali, Kamis (30/8).

Pemukulan terhadap ketua delegasi wasit karate Indonesia itu terjadi Jumat (24/8) lalu. Akibat pemukulan tersebut Donald mengalami luka cukup parah.

Insiden ini memicu berbagai aksi protes di Indonesia. Serangkaian demonstrasi digelar berbagai unsur masyarakat yang menuntut Pemerintah Malaysia meminta maaf.

Dijelaskan Dino, pembicaraan kedua kepala pemerintahan berlangsung dalam suasana konstruktif dan bersahabat. Menurut Dino, PM Malaysia menyatakan insiden itu tidak perlu terjadi.

Menurut Dino, Presiden Yudhoyono menghargai pernyataan PM Malaysia yang berupaya serta berniat baik untuk menghubungi Kepala Negara RI. Hal itu juga menunjukkan sikap arif Perdana Menteri Malaysia dan kedua pemimpin sepakat bahwa masalah itu perlu diselesaikan sesuai jalur hukum.

"Presiden menghargai langkah-langkah hukum dan tindakan indisipliner yang dengan cepat dapat diambil pemerintah Malaysia," katanya.

Kedua pemimpin mengharapkan, masalah itu dapat diselesaikan dengan cara yang baik dan cepat demi menjaga hubungan persaudaraan kedua negara yang selama ini berlangsung dengan kokoh.

Untuk itu, ujar Dino, Kepala Negara mengimbau semua pihak tetap bersikap tenang dan tidak terpancing emosi dalam kasus ini. Ia juga menginformasikan Kepala Kepolisian Diraja Malaysia telah menulis surat kepada Donald yang langsung diantarkan Duta Besar Malaysia kepada korban yang saat ini masih dirawat di rumah sakit. JAKARTA, August 30 - Anti-Malaysia demonstrations broke out in Indonesian cities after an Indonesian referee was beaten while in Kuala Lumpur for the 8th Asian Karate Championship at the Nilai indoor stadium.

In the East Java capital of Surabaya, dozens of youths conducted a sweep against Malaysian citizens at a local hotel in retaliation for the beating, which allegedly occurred at the hands of police officers.

A report by the detik.com online news service said dozens of youths went to the Garden Palace Hotel, searching for Malaysian badminton players who participated in a local competition.

Before conducting the search, the youths demonstrated outside the East Java regional legislative building, demanding the Indonesian government lodge a protest against the Malaysian police officers’ conduct.

The protestors urged the government to “immediately severe” its diplomatic ties with Malaysia and accused Malaysia of being an “uncivilised nation.”

Indonesian karate referee Donald Luther Kalapita was allegedly assaulted on Friday in Kuala Lumpur by four Malaysian police officers and had to be taken to a hospital for treatment of his injuries.

In protest against the beating, Indonesia withdrew from the karate event.

Similar anti-Malaysia rallies took place in North Sumatra’s capital, Medan, and Jakarta, where protestors demanded Kuala Lumpur apologise to Indonesia. – dpa as reported by the StarOnline

Najib to find out more details on allegations against IGP

PEKAN, July 1 - The Deputy Prime Minister’s office will find out more details on allegations that Inspector-General of Police Tan Sri Musa Hassan accepted bribes and of his alleged involvement with underworld figures.

Datuk Seri Najib Tun Razak said he was not aware of the postings on a website involving the country’s top police officer.

“I don’t know about the allegations. Let me check,” he told reporters after attending the ground-breaking ceremony of the Universiti Malaysia Pahang’s permanent campus in Kuala Pahang, near here, yesterday.

On Saturday, Deputy Internal Security Minister Datuk Mohd Johari Baharom was quoted by a local Malay daily as having said that the Anti-Corruption Agency (ACA) was free to investigate Musa over the allegations.

He said ministry secretary-general Tan Sri Abdul Aziz Yusoff would monitor developments.

Mohd Johari added that he too had been investigated over allegations of accepting RM5mil in bribes to release three men detained under the Emergency Ordinance.

The ACA has since completed investigations into Mohd Johari’s case and submitted its findings to the Attorney-General’s Chambers.

On a separate matter, Najib said he hoped all Umno divisional meetings would proceed smoothly.

He said he was optimistic about this, based on recently concluded branch meetings which had gone on uninterrupted in accordance with the party’s constitution.

“We hope that there will not be any unpleasant episode that requires the Umno disciplinary board to take action,” he said. theStarOnline

Suhakam: Police interfered with protesters’ right to assembly

KUALA LUMPUR, March 24 - Excessive force was used by certain police officers against a group of demonstrators at KLCC last year, with one officer being positively identified as one of the aggressors.

In Suhakam’s 355-page report of the public inquiry into the incident on May 28 last year, which was released yesterday, the panel found that excessive force was used on an otherwise peaceful assembly.

The report said excessive force was used on 10 persons and identified L/Kpl Mustika Lambonding as being the Federal Reserve Unit (FRU) officer who hit one of the demonstrators, Lee Huat Seng, with his baton.

However, witnesses were unable to identify the other officers because there was no identification (either names or badge number) due to the outer protective armour covering their uniforms (that had nametags).

The panel also examined whether the assembly at KLCC was peaceful and orderly, and the report included excerpts from the inquiry, particularly with the then Dang Wangi OCPD Asst Comm Kamal Pasha, who was the overall ground commanding officer that day.

ACP Kamal told the panel that he expected the crowd to be “unruly and rowdy,” in contrast with Chief Insp Pusparajan and L/Kpl Mohd Nasaruddin Abdul Aziz (both from the FRU), who felt that the crowd was orderly.

ACP Kamal said the crowd was uttering unpleasant words about the Government and that bystanders would have reacted by fighting among themselves.

Panel chairman Datuk K.C. Vohrah said the assembly at KLCC was peaceful and orderly and that the police, in dispersing the assembly, had interfered with the right to the freedom of assembly that was enshrined in Article 10 of the Federal Constitution.

Vohrah said the heart of the panel’s recommendations was the decriminalising of peaceful assembly without a licence under section 27 of the Police Act and the call for the repeal of related subsections.

“In lieu of the requirement for a licence, the panel recommends that the organiser of a proposed peaceful assembly notify the police, and the police and organiser discuss practical arrangements.”

The report’s recommendations added that the rights of any person engaged in lawful advocacy, protest or dissent are not limited by any authority and it should also be ensured that such rights would not be considered as prejudicial to national security.

The report also outlined a number of steps that it recommended the police implement urgently, such as wearing clear identification during crowd control, and prohibiting the chasing and arresting of people who are moving or have moved away.

The panel of inquiry that comprised Vohrah, Datuk Choo Siew Kioh, Datuk Dr Micheal Yeoh and Datin Paduka Zaitoon Datuk Othman, said the report would be forwarded to the related authorities on Monday. theStarOnline
