Najib enggan ulas isu Altantuya

KUALA LUMPUR, 30 Jun - Timbalan Perdana Menteri Datuk Seri Najib Tun Razak tidak akan memberi sebarang kenyataan berhubung dakwaan saksi mengenai gambar beliau (Najib) yang dikaitkan dengan perbicaraan kes pembunuhan wanita Mongolia, Altantuya Shaariibuu, yang sedang berlangsung di Mahkamah Tinggi Shah Alam kerana boleh dianggap sebagai mencampuri urusan mahkamah atau sub judice.

Setiausaha akhbar Timbalan Perdana Menteri, Datuk Tengku Sarifuddin Tengku Ahmad berkata bagaimanapun Najib tetap berpegang kepada kenyataannya yang dibuat beberapa kali sebelum ini bahawa beliau tidak pernah berjumpa atau mengenali mangsa dan tidak terbabit dalam kes itu.

"Saya ingin menjelaskan Timbalan Perdana Menteri telah beberapa kali semasa ditemubual oleh media sebelum ini dan semasa pilihan raya di Ijok mengatakan bahawa dia tidak pernah berjumpa, mengenali mangsa dan tidak terbabit dalam kes ini.

June 29 - A Malaysian government official identified as "Najib Razak" was photographed with a Mongolian woman and her lover who is now on trial in connection with her murder, a witness testified Friday.

The testimony electrified the courtroom and sparked angry exchanges between the prosecution and a lawyer for the family of the dead woman, who alleged in court that an aide to Malaysian Deputy Prime Minister Najib Razak had directed that the victim be taken away before her death.

Family of murdered model to sue Malaysian government, accused

KUALA LUMPUR, April 6 (AFP) - The family of a Mongolian model brutally murdered here is suing the Malaysian government and three people accused in the case, including a well-connected political analyst, lawyers said Friday.

Lawyer Karpal Singh said he would soon file a civil suit for damages by Setev Shaariibuu, the father of model Altantuya, 28, who was murdered and then her body blown into fragments by explosives in October last year.

Two police officers have been charged with the killing, while analyst Abdul Razak Baginda, whose connections reach as high up as Malaysia's deputy prime minister, has been charged with abetting in the crime.

Singh said the suit named the Malaysian government, as well as the three accused, who are due to stand trial on June 4.

"The suit is against the government because of the two police officers being agents of the government.... The government is also liable for the act," Singh told AFP.

"The suit is also against Abdul Razak Baginda as an ordinary person, who is also allegedly responsible for the crime," he said.

The murder has sent shockwaves through Malaysia because of the grisly nature of the crime, as well Abdul Razak's political connections.

Abdul Razak, who is married, in January admitted to having an affair with Altantuya, but said he wanted her out of his life after she demanded money.

Police have said the woman was kidnapped from outside Abdul Razak's home before she was killed.

Singh said Altantuya's father had legal custody of her two young boys, both below ten, and that he was seeking unspecified damages on the children's behalf to help support them.

"The children don't have any financial support now. She was supporting them," Singh said.

"I won't specify the amount but the children have to be supported right up until the age of 18. It will be quite a substantial amount," he added.

Singh said he was filing the suit in the high court in Shah Alam, west of Kuala Lumpur, "very soon" and that he expected the case to be heard after the criminal trial.

"We have to wait for the criminal case to be over. If they are found guilty, the government may well want to settle it," said Singh.

Abdul Razak and the two police officers, both from Malaysia's elite Special Action Force, face the death penalty if found guilty.

DNS Test Results On Altantuya's Son To Be Out Saturday

KUALA LUMPUR, March 12 (Bernama) -- Results of the DNA test on Altanshagai Munkhtulga, 4, son of Altantuya Shaariibuu, the Mongolian model who was murdered last November is expected to be out by this Saturday.

The Mongolian consul in Malaysia, Datuk Syed Abdul Rahman Al-Habshi said the test would be conducted at the National Hospital of Ulan Bator (NHUB) Wednesday morning.

"Our special team comprising Federal CID deputy director (II) Datuk Syed Ismail Syed Azizan, Kuala Lumpur deputy serious crimes chief DSP Gan Tack Guan and a forensic specialist Dr Azreen from Kuala Lumpur, will witness the test to ensure the test is conducted fairly.

"NHUB officials told me that it would take about two or three days to conduct a thorough DNA test. I have learnt the final result of the test is very vital for the prosecution on the June trial, to determine the real father of Altanshagai," he told Bernama here Monday.

Abdul Rahman said the team would be leaving this midnight and his counterpart in Ulan Bator had already been informed of the visit.

"A Mongolian Interpol officer informed me this morning that our special team will be receiving a VIP treat. There, both parties will have discussion on the DNA test process and other related matters.

"Even Dr Shaariibuu Setev (Altantuya's father) called me yesterday and promised me that he will give his full cooperation to our special team in order to expedite the DNA test," Abdul Rahman said.

On Sunday, Bernama reported Altanshagai's health condition was turning for the worse as he was suffering from a severe brain disease which had caused his head to be swollen.

Altantuya was murdered and her body blown to bits by explosives at a secondary forest near the Subang Dam in Puncak Alam, Shah Alam last November.

Meanwhile on Friday, the Shah Alam High Court decided to bring forward the murder case trial to June 4 this year and 25 days have been set aside for the hearing, after the same court had originally fixed March 10 next year for the trial because of a heavy backlog of cases.

C/Insp Azilah Hadri, 30, and Corporal Sirul Azhar Umar, 35, have been charged with murdering Altantuya while a prominent local political analyst, Abdul Razak Baginda, 46, has been charged with abetment.

The trio are alleged to have conspired to commit the murder at Bangunan Getah Asli in Jalan Ampang here between 9.45am and 11.05am on Oct 18 last year.

PETALING JAYA (March 8, 2007) - The lawyer holding a watching brief for Altantuya Shaariibuu's family in the high-profile murder trial wants an explanation on why the trial judge has been changed.

Karpal Singh said the public would want to know why the case, which was to be heard by Shah Alam High court judge Datuk K.N. Segara, was now being placed before Judicial Commissioner Datuk Mohammad Zaki Md Yassin.

He called upon the Chief Judge of Malaya to explain why the case was brought forward from March 10 next year to tomorrow and placed before another judge.

Kamarul Hisham Kamaruddin, the defence counsel for Corporal Sirul Azhar Umar, 35, one of the two policemen charged with the Mongolian's murder, was also quoted by a newspaper as having said he would seek an explanation for the change of trial judge.

"I am not aware why this was done but I will definitely ask for a reason when the case comes up for mention," he said .

Wong Kian Kheong, the lawyer for political analyst Abdul Razak Abdullah, who is charged with abetting in the murder, had no comments when contacted.

It was reported his client, who is in remand, had applied for an earlier date.

Corporal Sirul and Chief Insp Azilah Hadri, 30, were charged with murdering Altantuya in Bukit Raja, Selangor.

Razak is alleged to have abetted in the offence between 9.54am and 11.05am on Oct 18 in Bangunan Getah Asli.

According to a Shah Alam High Court statement, the case was brought forward as there had been a distribution of cases after three new judicial commissioners joined them from March 1.

The three are Datuk Mariana Yahya, P. Nallini and Abang Iskandar Abang Hashim.

A letter from High Court deputy registrar Rofiah Mohamad to the prosecution and defence teams, the Shah Alam High Court (criminal division) got an additional three new judicial commissioners to handle backlog criminal cases in the high courts.

The statement said following this, senior judge Segara re-distributed the cases among the six judges and judicial commissioners.

The purpose of restribution is to reschedule the dates of the hearings, by giving priority to cases, in which the accused were in remand for a long period and for cases invoving government servants, in order to speed up trial dates. sun2surf

PUTRAJAYA, March 5 (Bernama) - The criminal case involving political analyst Abdul Razak Baginda who was charged with abetting in the gruesome murder of Mongolian model Altantuya Shaariibuu will be mentioned before the Shah Alam High Court this Friday.

Counsel Zulkifli Noordin said the case, which was previously heard by Judge Datuk K.N. Segara will be heard before judicial commissioner Datuk Mohd Zaki Md Yassin.

No reason was given.

Zulkifli is representing two policemen, C/Insp Azilah Hadri,30, and Kpl Sirul Azhar Umar, 35, who were accused of killing Altantuya.

The case was expected to come up before the Shah Alam High Court only next year as Segara had on Jan 5 this year, fixed four days beginning March 10 next year for trial.

It was learnt that Razak had sent a letter to the Shah Alam High Court to expedite the trial.

Razak, 46,is accused of abetting Azilah and Sirul Azhar to commit the murder, which ended with the body of the 28-year-old Altantuya being blown to bits with explosives. Her remains were found at a forest area in Puncak Alam in Shah Alam on Nov 7 last year.

He allegedly committed the offence between 9.54am and 11.05am on Oct 18 at Level 10, Bangunan Getah Asli, in Jalan Ampang, Kuala Lumpur. This is the official address of the Malaysian Strategic Research Centre, which Razak heads.

Azilah and Sirul Azhar, both from the special unit force were accused of murdering Altantuya in Lot 12843 and Lot 16735, Mukim Bukit Raja, Selangor, between 10 pm, Oct 19 and 1 am, Oct 20 last year.

Abdul Razak was charged under Section 109 of the Penal Code, read with Section 302 of the same Code, which carries the mandatory death sentence, if convicted.

Last week, Chief Justice Tun Ahmad Fairuz Sheikh Abdul Halim said the criminal case in the Shah Alam High Court which was fixed next year, would be brought forward to this year.

High Court Dismisses Razak Baginda's Bail Application

SHAH ALAM, Jan 19 (Bernama) -- The High Court Friday dismissed an application for bail by political analyst Abdul Razak Abdullah Baginda who is charged with abetting the murder of a Mongolian model last year.

With the application struck out, Abdul Razak will be in jail pending hearing of the case which has been fixed for next year.

Judge Datuk K.N. Segara rejected the application on the grounds that Abdul Razak did not submit his medical report and that the offence facing him was a serious one.

Last Dec 14, the same judge had struck out Abdul Razak's oral application for bail and ordered the accused to file in a formal application.

The court fixed today to hear the application by Abdul Razak who was represented by counsel Wong Kin Kheong.

Abdul Razak, 46, is charged with abetting two policemen from the Bukit Aman Special Action Unit in the murder of Mongolian Altantuya Shaariibuu, 28, at the 10th floor, Bangunan Getah Asli in Jalan Ampang, Kuala Lumpur, between 9.54am and 11.O5am on Oct 18 last year.

The public is entitled to know that investigations on the murder of Mongolian national Altantuya Shaariibuu were carried out without fear or favour, and that all those responsible will be brought to book, said Parti Keadilan Rakyat adviser Datuk Seri Anwar Ibrahim.

Speaking in a press conference in his residence today, he said questions had also been raised about whether Altantuya had a role in the government's purchase of the Scorpene and Agosta submarines from France in a deal costing nearly 1 billion euros (RM4.6 billion).

"We find it totally unacceptable the reasons given by the government that there is no question of corruption or accountability because the commission that was paid was between the seller and a third party and did not involve government funds.

"This is a blatant lie because no manufaturer would give such huge commissions unless that has already been factored into the pricing of the purchases of the submarines," he said.

"The payment of this commission of 114 million euros (RM530 million) is exorbitant by any standard. The public has the right to know who are the beneficiaries of this massive payout?" he added.

Anwar said the Far Eastern Economic Review in 2002 had reported that Perimekar Sdn Bhd would receive 8% of the total contract value over the next six years.

He said according to the publication, Perimekar was fully owned by Ombak Laut, a company owned by Abdul Razak Abdullah and his associates.

He said Ombak Laut then sold 40% of Perimekar to Lembaga Tabung Angkatan Tentera and a sister company.

Asked how he came to know about all this, Anwar said he was privy to some of the information - but did not eleborate how - while the rest was publicly known.

Political analyst Abdul Razak is charged with abetting in the murder of Altantuya, 28, on Oct 18.

During the press conference, the former deputy prime minister also commented on the Election Commission (EC) chairman's call on Monday (Jan 8, 2007) for legislative reform so that the commission can uphold the democratic process of fair and transparent elections.

He said the chairman's admission showed that the entire process was flawed in the past.

"(The previous elections were) not free, no access to the media and certainly many regulations are considered to be bias," he said.

He added that if nothing was done following the chairman's call, it would be a "mockery of the entire electoral process."

Anwar also commented on the agreements between the government and highway concessionaires, saying if there was compelling reason to suggest that the terms of the agreements were not transparent and fair, then a renegotiation was warranted.

On Tun Dr Mahathir Mohamad's remark that the cabinet was not always knowledgeable and politicians, including himself, could sometimes be "stupid," Anwar said they would "have to pay for the stupidity" and "don't get the poor to pay for the stupidity."

Court Of Appeal Says No To Abdul Razak's Bail Application

PUTRAJAYA, Jan 11 (Bernama) -- Political analyst Abdul Razak Abdullah Baginda who is charged with abetting the murder of Mongolian model Altantuya Shaariibuu will remain behind bars as he failed in his attempt Thursday to reverse the court's decision denying him to be freed on bail.

A three-man Court of Appeal bench headed by Justice Datuk Mokhtar Sidin unanimously struck out Abdul Razak's application to revise the Shah Alam High Court's decision on Jan 5 which had reverted his oral application to extend his bail which had expired on that day.

Mokhtar said the application Thursday was still premature.

On Jan 5, Shah Alam High Court judge Datuk K.N. Segara had refused to extend Abdul Razak's bail on the grounds that he (Abdul Razak) should make a formal bail application.

Following the decision Thursday, Abdul Razak, 46, will be sent to the Sungai Buloh prison and will remain there until a decision is made on the application.

However, Abdul Razak has another avenue, to enable him to be freed on bail, pending his trial which is set on March 10 next year.

This is made available to Abdul Razak as he had already filed a formal bail application as ordered by the Shah Alam High Court on Jan 5. His application will be heard on Jan 19. more..

Razak's Wife Mocks Journalists

SHAH ALAM, Jan 5 (Bernama) -- The wife of political analyst Abdul Razak Abdullah Baginda, who is charged with abetment in the murder of Mongolian beauty Altantuya Shaariibuu, mocked journalists covering the case at the High Court here Friday.

"So happy now? Satisfied?" Mazlinda Makhzan sneered at the journalists before joining Abdul Razak, who was in handcuffs, being led out of the court by several policemen.

Mazlinda is believed to have lashed out her frustration at the journalists following the court's refusal to entertain an oral application by counsel Wong Kian Kheong for Abdul Razak be released on bail.

On Dec 14 last year, the Shah Alam High Court allowed Razak to be released on a RM1 million court bond with two sureties after he claimed trial to a charge of abetting in the 28-year old Altantuya's murder.

Mazlinda was also seen attempting to prevent press photographers from taking pictures of her husband as he was brought to the court lock-up.

Abdul Razak, 46, is charged with abetting Chief Inspector Azilah Hadri, 30, and Corporal Sirul Azhar Umar, 35, in the murder of Altantuya, 28, whose body parts were found in a forest area at Puncak Alam here on Nov 5 last year.

He is alleged to have committed the offence at Bangunan Getah Asli in Jalan Ampang, Kuala Lumpur, between 9.54am and 11.05am on Oct 18 last year.

Abdul Razak Back In Jail As Court Refuses To Entertain Oral Bail Application

SHAH ALAM, Jan 5 (Bernama) -- Political analyst Abdul Razak Abdullah Baginda, who has been charged with abetment in the murder of Mongolian beauty Altantuya Shaariibuu, was sent back to prison Friday after he failed to get his bail extended.

Shah Alam High Court Judge Datuk K.N.Segara refused to entertain an oral application for the extension as well as interim bail made by his counsel Wong Kian Kheong and ordered Wong to file in a formal application.

"Make a formal application. This is a serious charge. I am not interested (to hear the oral bail application). I want it in the affidavit. You had more than sufficient time to do so. I have already made the ruling and will not entertain anything else," said Segara who insisted that he needed to proceed hearing another case involving an Iranian man remanded since 1999, and subsequently left the court.

In the afternoon, Wong filed the formal bail application to have Abdul Razak, 46, released from prison while awaiting his trial. The court fixed Jan 19 to hear the bail application.

Abdul Razak was then sent to the Sungai Buloh prison and will remain there until a decision is made on the application.

Abdul Razak, 46, had earlier been allowed to be released on RM1 million bail in two sureties but it expired today. He appeared shocked by the court's decision and was seen discussing it with Wong. He was also seen embracing his wife Mazlinda Makhzan and daughter Roweena. more..

Model's murder raises explosive questions for Malaysian minister

THREE men will appear in Malaysia's Shah Alam High Court today in a case that has riveted the country's media and political classes.

The murderous drama involves a beautiful Mongolian model, a Muslim political analyst with friends in the highest places, and an explosive cover-up — the body was blown to bits.

Altantunya Shariibuu, a 28-year-old mother of two, was kidnapped on October 19. She was allegedly shot twice in the head, and her blown-up remains were found in forest at Shah Alam, south of Kuala Lumpur. She was identified by DNA taken from bone fragments.

Respected political analyst Abdul Razak Baginda, 46, who was allegedly her lover, has pleaded not guilty to abetting murder, a charge that carries the death penalty.

The prosecution case hinges on an alleged meeting between Abdul Razak and two elite police officers at his Kuala Lumpur office the day before the kidnapping. The two officers, special taskforce Chief Inspector Azhila Hadri, 30, and Corporal Siral Azhar Umar, 35, are also charged with murder. They have not entered a plea.

Abdul Razak is a confidant of Malaysia's Deputy Prime Minister and Defence Minister, Najib Abdul Razak.

Although Mr Najib has not been formally implicated in the case, questions have been raised about the alleged involvement of special taskforce police and whether the apparent use of C4 explosives points to an abuse of Defence Ministry power.

Malaysia's elite has not seen anything like it since former deputy prime minister Anwar Ibrahim was falsely accused of sodomising his driver.

Unlike Mr Anwar, who was beaten up by the police chief and jailed for six years, Abdul Razak was charged and then released on health grounds in late November, on an unguaranteed bail bond. This had never been allowed before in a Malaysian murder trial, but there was no protest from prosecutors.

The victim's father, Setev Shaariibuu, travelled from Mongolia to Malaysia to seek justice for his daughter.

"This is an international case, this is a brutal murder," he told reporters after Abdul Razak was released. "It was all about releasing him, all about his family, and his background … I hope justice will be served."

Early in the case, Malaysian Prime Minister Abdullah Badawi promised there would be no cover-up, but the Government has since refused to comment, saying the case is before the court.

That has not stopped opposition politicians. In Parliament, Karpal Singh of the Democratic Action Party has claimed the C4 explosives could only have been found in the Defence Ministry.

"So what was the link of the Defence Ministry (with the case)?" he reportedly asked Parliament this month. "Why was Altantunya's body exploded? Was she pregnant? Are the police afraid to investigate because it involved a highly placed minister?"

Another opposition politician, Syed Husin Ali of the People's Justice Party, said: "Should the Government continue to be silent, rumours will spread even further and will eventually be accepted as the truth by the public." The trial is expected to begin next year. The Age.

Mongolians demonstrate against Malaysia

Demand apology and compensation for murder of Mongolian beauty in KL.

Mongolians held a rally on Wednesday (Dec 6) in their capital’s National IT Park to protest against the murder of one of their citizens in Malaysia.

(Mongolian beauty, Altantuya Shaaribuu 28-year-old mother of two were abducted and murdered in Kuala Lumpur, and two policemen were last month charged for the murder.)

The Mongolian National Centre Against Violence organized the joint meeting with other human rights, women’s rights, and children’s rights organisations, reported UP Post.

“We Demand Justice” was the unanimous demand at the gathering, the independent weekly reported.

Another person, political heavyweight Abdul Razak Abdullah Baginda, a close aide of Deputy Prime Minister Najib Tun Razak, had been charged for abetment.

But in a surprising decision, Abdul Razak was released on a M$1m court bond after he claimed trial to a charge of abetting in the murder of Miss Altantuya.

Press reports had said they had been having an affair and she had arrived in KL threatening to expose it to his wife.

Abdul Razak, 46-year-old political analyst, was allowed to go home after a High Court allowed his release under the bond (which was without security) due to his ‘poor health’.

Altantuya’s father, Dr Shaariibuu Setev, who attended the court proceedings, told reporters that he was not satisfied with the outcome, saying all that the lawyers spoke about was Razak, his reputation and who he was.

“I hope justice will be served,” he said, adding that he would not hesitate to bring the matter to the international arena if he found the trial was not fair.

Wednesday’s protest was the first public sign of anger about the case in Mongolia.

It began with the assembly standing for a minute in silence in the victim’s memory. A short documentary film about her life was then shown.

The alliance of human rights organisations and women’s non-profit organisations urged the Government of Malaysia: -

* To apologise to the people of Mongolia for the murder, and

* To pay for the support of the victim’s children until they reach majority, including their medical expenses.

“I hope that the Government of Malaysia apologises. We also demand a fair trial and that full justice is seen to be done,” said Altanzul, a sister of Altantuya.

The organizers said the KL government should apologise as police officers, who are part of the State’s legal enforcement machinery, were found to be involved

“The final hearing of the trial will be next week. The reputation of the Malaysian judicial system itself is on trial at the international level.

"The people of Mongolia, especially its national network of human rights organisation, are watching carefully how this case proceeds.

“We hope some human rights organisations in Malaysia would support us in this respect and put pressure on their government,” she said.

The Government of Mongolia has to protect its citizens abroad, and this does not mean merely sending formal letters, according to many of the speakers.

The gathering has sent two letters of demand, one to the President of Mongolia, its government, and parliament, and the other to the King of Malaysia, its government, and parliament.

Deputy Internal Security Minister Datuk Mohd Johari Baharum says C4 explosives were not only used by the army but also the police Special Action Unit (Unit Tindakan Khas).

However, Johari declined to comment further on the murder of a Mongolian beauty in which C4s were believed to have been used.

"I can't give any information as the case is now in the court," he said in his winding up speech for the ministry in Parliament today.

On the fiery speeches by some Umno members in the recently-concluded Umno general assembly, Johari said the police had completed its investigations and the investigation papers have been submitted to the Attorney-General (A-G) for a decision.

When quizzed on the proposed Independent Police Complaints and Misconduct Commission (IPCMC), Johari reiterated that the matter was still being studied by the A-G.

Earlier, Karpal Singh (DAP-Bukit Gelugor) in his debate urged the police to investigate whether the murder of Mongolian Altantuya Shaariibuu is related to any minister.

He said the police should also probe the statement made by the wife of high-profile political analyst Abdul Razak Baginda who has been charged with abetting in the murder.

"Can the police get a statement from her to determine what she meant by saying 'He is a good man. He is not the prime minister of this country. He doesn't want to be one?' What did that mean?" he asked.

Karpal Singh also claimed that the C4 explosives used to blow up the body of Altantuya after she was killed could only be found in the Defence Ministry, not in any police station or Bukit Aman

"So what was the link of the Defence Ministry (with the case)?" he asked.

At this juncture, Deputy Speaker Datuk Dr Yusof Yacob interjected. Citing the case was in the court now, he tried to stop Karpal Singh from making further comments about the case.

Karpal Singh explained that although the case was in court, it does not prohibit the police from carrying out investigations.

He then raised another question: "Why was Altantuya's body exploded. Why was she was blown up? Was she pregnant? Was this why she was exploded? Can we investigate this aspect?

"Some said the case involved highly placed people. If so, who is this highly placed minister? Is the police afraid to investigate because it involved a highly placed minister?"

Karpal Singh said the Mongolian government is monitoring the case daily.

Seeing Karpal Singh had no intention to stop talking on the topic, Badruddin Amiruldin (BN-Jerai) said: "The case is in the proceeding (court proceeding). How can we debate this?"

Lending support to his party colleague, Opposition Leader Lim Kit Siang said everyone must remain rational about the case and that issues concerning public interest should be allowed to be debated.

Karpal Singh said: "The most important thing in the case is don't erase whatever that's needed to be exposed."

His speech ended when Yusof ruled his time for the debate had ended.

The Budget 2007 Bill was passed by the Dewan Rakyat after 32 days of debate.
